OFFICIAL CONTEST RULES
SUMMARY
All TwinSpires.com players meeting the ELIGIBILITY requirements below may participate.
Players may participate by placing a Win wager of $10 or more on the horse American Pharoah in the Breeders’ Cup Classic race, starting at 1 p.m. Eastern Time, Friday, October 30, 2015, with their TwinSpires.com account.
Starting at 1 p.m. Eastern Time on Friday, October 30, 2015, only the first 2015 unique players to place a Win wager of $10 or more on American Pharoah through TwinSpires.com will be eligible to receive a prize.
Only Win wagers of $10 or more on American Pharoah (and no other horses) will qualify. Combination Win/Place, Win/Place/Show or Win/Show wagers are not eligible for contest play.
Once either 2015 unique players have placed a qualifying Win wager on American Pharoah or wagering is closed at post time for the Breeders’ Cup Classic (Keeneland race 11 on October 31), whichever occurs first, no further players will be eligible to receive a prize.
Limit one (1) prize per account holder regardless of the number of wagers placed.
The 2015 qualifying players will be listed on the TwinSpires.com website on Saturday, October 31, 2015. Players will be identified by their first name, last initial, last three digits of their account number and will be listed in the order of the time that their wager was placed starting at 1 p.m. Eastern Time, on October 30, 2015.
PRIZES
If American Pharoah wins the 2015 Breeders’ Cup Classic, all 2015 qualified players will receive a genuine $2 Pari-mutuel Win ticket on American Pharoah from the 2015 Breeders’ Cup Classic at Keeneland. The win ticket will have an actual cash value equal to the $2 Pari-mutuel Win payout for American Pharoah in the 2015 Breeders’ Cup Classic.
No prizes will be awarded under the following conditions:
• If American Pharoah does not win the 2015 Breeders’ Cup Classic, no prizes will be awarded.
• If Ameican Pharoah is scratched from the Breeders’ Cup Classic, no prizes will be awarded and all Win bets on American Pharoah will be refunded.
• If the 2015 Breeders’ Cup Classic is declared a no-contest or is cancelled and not rescheduled.
If there is a dead-heat to Win involving American Pharoah and another horse or horses, the prizes will be awarded as scheduled.
*The official winner of the 2015 Breeders’ Cup Classic will be the horse that is placed first in the official pari-mutuel results published by Equibase for race 11 at Keeneland on October 31, 2015. Any disqualification that may occur after the day of racing, resulting in a horse other than the pari-mutuel race winner being awarded first place prize money shall have no bearing on results of this Contest.
ELIGIBILITY
a) The American Pharoah Win Ticket Contest (the “Contest”) is open to TwinSpires.com registered players only; legal residents of the United States who are at least 18 years or older. The following states have higher age requirements: Alabama (min. age 19), Iowa (min. age 21), New Hampshire (min. age 21), Washington (min. age 21). TwinSpires.com is a free service; sign-up opportunities exist via www.twinspires.com or by calling 877-SPIRES-1.
b) Employees, agents, successors, and assignees of Sponsor, its advertising agencies and Contest companies involved in this Contest, as well as family and household members of same, shall be ineligible to participate in the Contest and shall be ineligible to receive any prize awarded in this Contest.
c) No person may enter for another person, or in another person’s name. Any person found violating any of these provisions will be disqualified and the entry submitted by said person shall be ruled ineligible for prize awards.
d) By entering, all participants and/or entrants release Churchill Downs Technology Initiatives Company and its parent company, subsidiaries, and affiliates, and their respective employees, officers, directors, agents and shareholders, from and against all claims and damages arising in connection with each entrant’s participation and/or entry in this Contest and/or their receipt or use of any prize awarded in this Contest. This Contest is governed by U.S. law and is void where prohibited by law.
METHOD OF ENTRY
The Contest is open to all TwinSpires.com customers who have a valid, open and funded TwinSpires.com wagering account. Players with valid TwinSpires.com wagering accounts may automatically enter the Contest starting at 1 p.m. Eastern Time, on October 30, 2015, by placing a Win wager for $10 or more on the horse American Pharoah in the 2015 Breeders’ Cup Classic using their TwinSpires.com account. Starting at 1 p.m. Eastern Time on October 30, 2015, only the first 2015 unique players to place a Win wager for $10 or more on American Pharoah, will qualify to win a prize in this contest.
The 2015 qualifying players will be listed on the TwinSpires.com website by the end of racing on Saturday, October 31, 2015. Players will be identified by their first name, last initial, last three digits of their account number and will be listed in the order of the time that their wager was placed, starting on October 30, 2015, at 1 p.m. Eastern Time.
NO PURCHASE NECESSARY
Whether a customer is among the first 2015 players to qualify to win a prize or not, a player who places a qualifying wager on the Breeders’ Cup on Friday, October 30 ONLY, may cancel that wager on Saturday, October 31, 2015, prior to the running of the 2015 Breeders’ Cup Classic, and receive a full refund for that wager. Placing a qualifying wager on Friday, October 30 and cancelling it on Saturday, October 31 will not disqualify a player from winning a prize.
CONDUCT
Churchill Downs Incorporated and TwinSpires.com each reserves the right, in its sole discretion, to modify, cancel, terminate, and/or suspend the Contest and to disqualify any individual who tampers with the process, violates these official rules, or acts in a disruptive or unsportsmanlike manner. Without limiting the foregoing, Churchill Downs Incorporated and TwinSpires.com may, in its sole discretion, prevent an entrant who has been disqualified, has questionable eligibility, or is otherwise ineligible to receive a prize, from continuing to participate in the Contest.
GENERAL CONDITIONS
TwinSpires’ decisions with respect to any winners and any other matters pertaining to the Contest shall be final. If prizes are awarded, all prizes will be delivered by U.S. mail to the mailing address on file for each winning player. In the event the prize is not deliverable by U.S. mail, TwinSpires.com will attempt to contact the winner by e-mail and/or telephone to obtain a current address. In the event a prize winner cannot be contacted by U.S. Mail, e-mail or telephone, the prize will be forfeited and an alternate prize winner shall be selected. Please allow between 6 to 8 weeks after the running of the Breeders’ Cup Classic for prize delivery. By entering the Contest, all entrants consent to the use of their name, for advertising and Contest purposes, including online announcements, worldwide and without limitation and without additional compensation, except where prohibited by law. The odds of winning depend upon how many unique players place a Win bet for $10 or more on American Pharoah through TwinSpires, starting at 1 p.m. Eastern Time on Friday, October 30 and if American Pharoah wins the Breeders’ Cup Classic race at Keeneland on Saturday, October 31.
All costs, taxes, fees, and expenses associated with a prize or the acceptance and use of any element of a prize not specifically addressed above are the sole responsibility of the respective winner. All federal, state, and local taxes on prize are winner’s responsibility. Prizes may not be transferred or exchanged.
INTERNET/TECHNOLOGY PROBLEMS
If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of TwinSpires, which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, TwinSpires and its affiliates/agents reserve the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest and select winners in a manner, which in the sole judgment of TwinSpires, is fair, appropriate and consistent with these Official Rules. TwinSpires and its affiliates/agents reserve the right to disqualify any individual who violates these Contest Rules or the associated rules sets referenced. Herein, if anyone tampers with the entry process or engages in any conduct detrimental to TwinSpires, the Contest or any other player (in each case as determined at TwinSpires’ sole discretion), to lock out any individual whose eligibility is in question, and to cancel, terminate, modify or suspend this Contest at any time. The Released Parties assume no responsibility for, and will not be liable for, any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. None of the Released Parties are in any way responsible or liable for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by TwinSpires on account of technical problems or traffic congestion on the Internet or at any associated Web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading of any materials in this Contest.
NOTIFICATION
Winners will be notified by e-mail. In the event of a dispute about the identity of any player, entries made online will be declared made by the authorized account holder of the TwinSpires account submitted at time of entry. A potential winner will be required to provide proof that the potential winner is the authorized account holder of the TwinSpires account associated with the winning entry.
RULES AND WINNERS LIST
This Contest is subject to these Contest Rules and any other rules set expressly referenced herein. Game players agree to abide by the terms of these Contest Rules and by the decisions of TwinSpires, which are final on all matters pertaining to this Contest.
TwinSpires reserves the right to change these Contest Rules at any time, in its sole discretion. Contest rules may be obtained on the TwinSpires website.
A winners’ list will be posted on the TwinSpires website no later than one day after the Breeders’ Cup Classic stakes is official and may also be obtained by sending a SASE to the address below.
