A Jackpot 8 pari-mutuel pool will only be potentially available if a race with ten (10) or more separate betting interests (horses) are running. If, due to a late scratch, the number of betting interests in the Octafecta pool is fewer than ten (10) separate betting interests at the time of the start, the pool will be cancelled and all monies, with the exception of any carryover monies, shall be refunded.

If a betting interest (horse) in the Jackpot 8 pool is scratched from the race, wagers will no longer be accepted. All tickets previously sold designating that horse shall be refunded and that money shall be deducted from the gross pool.

If there is a dead heat for any position among the first eight finishers, all horses involved in the dead heat shall be considered official finishers for that position. A ticket correctly selecting the order of finish, including any horse involved in the dead heat, shall be considered a winning ticket.

The Octafecta Jackpot carryover is not automatically subject to a mandatory payout on the final day of a racing meeting at any track or association. A mandatory payout, if any, will be determined by the hosting association with notification to the corporation.

If the association elects to hold over the Jackpot 8 carryover to the corresponding Octafecta pool of a subsequent meeting, the carryover may be deposited in an interestbearing account approved by the corporation. The Octafecta carryover plus accrued interest shall then be added to the net Octafecta pool of the meeting of the association from which the Octafecta pool initially originated or subject to an agreement with another association pursuant explanation below.

The Octafecta Jackpot carryover shall be retained by the association from which the Jackpot 8 pool initially originated and, upon agreement between the association from which the Octafecta pool initially originated and any other association, may be transferred to the corresponding Octafecta pool conducted at any subsequent race
meeting held by any other association, upon notification to the corporation. The agreement between the initiating association and any subsequent associations shall determine the handling of the Octafecta wager according to the rules approved by the corporation. The originating association will notify the corporation of any changes to the agreement.

In the event that the association elects to pay consolation prizes for the daily “best ticket,” or on any day designated for a mandatory payout of the Octafecta, the association shall make a distribution of the Jackpot 8 pool as a single‑price pool, which shall consist of a share of the net pool from the Octafecta wager conducted on that day and a share of the accumulated carryover funds, as determined by the association, to the following parties:

• Individuals with tickets selecting the first eight (8) finishers, in exact order, for the designated race, or, if there are not any of those wagers, to;
• Individuals with tickets selecting the first seven (7) finishers, in exact order, for the designated race, or, if there are not any of those wagers, to;
• Individuals with tickets selecting the first six (6) finishers, in exact order, for the designated race, or, if there are not any of those wagers, to;
• Individuals with tickets selecting the first five (5) finishers, in exact order, for the designated race, or, if there are not any of those wagers, to;
• Individuals with tickets selecting the first four (4) finishers, in exact order, for the designated race, or, if there are not any of those wagers, to;
• Individuals with tickets selecting the first three (3) finishers, in exact order, for the designated race, or, if there are not any of those wagers, to;
• Individuals with tickets selecting the first two (2) finishers, in exact order, for the designated race, or, if there are not any of those wagers, to;
• Individuals with tickets selecting the winner for the designated race, or, if there are not any of those wagers;
• All money wagered into the Octafecta pool that day shall be retained and added to the Octafecta pool the next racing day or subsequent race meeting, as applicable.
